1. Definitions

"The site" or "site" refers to this website, maintained on the World Wide Web by 1668868 Ontario Inc. "User," or collectively "Users," refers to any party who accesses the site. "Access" means viewing or otherwise obtaining information located on the site. "Agreement" refers to these Terms of Service and any subsequent modification.

2. Acceptance of terms

By accessing the site, the User accepts and agrees to all conditions imposed in this Terms of Service Agreement. 1668868 Ontario Inc. reserves the right to modify these Terms at any time without notice. Any change is effective immediately upon the User's receipt of notice, which may be given by email, by posting on the site, or by any other means. Users should periodically check these Terms for changes; any use of the site after changes are made is deemed acceptance of those changes. The User is solely responsible for providing the equipment needed to access the site.

3. User accounts

If you establish an account to purchase products or receive information from us, you are responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. 1668868 Ontario Inc. reserves the right, in its sole discretion, to refuse service, cancel orders, or terminate your account.

4. Copyright and marks

All content on the site (other than content provided by third-party content providers or posted by Users) is the copyrighted property of 1668868 Ontario Inc. Site contents may not be copied, reproduced, modified, published, uploaded, posted, transmitted, "framed" on another site, or distributed in any way without prior written consent. Any third-party marks and content appearing on the site are the property of their respective owners and may not be used without permission.

5. Prohibited conduct

The User expressly agrees to refrain from, either personally or through an agent, any of the following:

• Using any device or means to harvest information about other Users
• Transmitting or uploading any virus or other item that affects the use, enjoyment, or service of the site or any User's computer
• Posting material that is offensive to any other User, as determined by 1668868 Ontario Inc.
• Posting or storing content that violates or infringes the intellectual property rights of others
• Modifying information, including headers, found on the site
• Transmitting any unauthorized advertisement or communication
• Using the site for any unlawful or defamatory means
• Attempting to access the personal information or account of another User
• Using any "deep-link", "page-scrape", "robot", "spider", or other automatic device to access, copy, or monitor any portion of the site
• Probing, scanning, or testing the vulnerability of the site or any connected network, or breaching its security or authentication measures

6. Disclaimer and limitation of liability

Although 1668868 Ontario Inc. has attempted to provide accurate information, it makes no guarantee or warranty as to the reliability, accuracy, timeliness, or completeness of that information. The User accesses this site at their own risk. The site is provided on an "as is, as available" basis without warranty of any kind, and all warranties of merchantability, fitness for a particular purpose, or non-infringement are specifically disclaimed. Neither 1668868 Ontario Inc. nor its affiliates, employees, agents, or third-party content providers shall be liable for any loss resulting from use or unavailability of information or content on this site.

7. Third party content

1668868 Ontario Inc. is not the publisher or speaker of information provided by third-party content providers or Users, and is not liable for any claims related to that information. Any mention of products or services provided by third parties is for informational purposes only and constitutes neither an endorsement nor a recommendation. Any dealings between a User and any third parties are solely between them.

8. User content

From time to time and at its sole discretion, 1668868 Ontario Inc. may post content submitted by Users, including product reviews or comments ("User Content"). Users may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any User Content. Users retain copyright in their User Content but grant 1668868 Ontario Inc. a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, publish, translate, distribute, and display it worldwide in any media.

9. Indemnification

The User agrees to defend, indemnify, and hold harmless 1668868 Ontario Inc. and its officers, directors, agents, employees, and assigns from and against any cause of action or claim, including legal fees, related to the User's use of the site.

10. Security

Users are prohibited from violating or attempting to violate the security of the site. 1668868 Ontario Inc. will investigate occurrences of possible violations and will cooperate with applicable law enforcement authorities in prosecuting violators.

11. Violation of these terms

1668868 Ontario Inc. may disclose information about you if it determines that doing so is necessary in connection with any investigation or complaint regarding your use of the site, or to protect its rights or property or those of its visitors and customers, or to comply with applicable law, regulation, or legal process. 1668868 Ontario Inc. may, in its sole discretion and without prior notice, terminate or block your access to the site if it determines that you have violated these Terms.

12. Termination of agreement

Either 1668868 Ontario Inc. or the User may terminate this Agreement at its discretion. 1668868 Ontario Inc. may terminate access to this site or cancel membership to any service it provides if the User breaches this Agreement or engages in conduct it deems inappropriate. Upon termination, the provisions in paragraphs 4, 5, 6, 7, 8, 9, and 11 shall survive.

13. Links

The User is granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the site, so long as the link does not portray 1668868 Ontario Inc. or its products or services in a false, misleading, derogatory, or otherwise offensive manner. The User may not use any logo, proprietary graphic, or trademark as part of the link, or use framing techniques or hidden text, without express written consent.

14. Copyright protection

1668868 Ontario Inc. honors the intellectual property rights of others and asks the same of Users. It may, in its sole discretion, terminate the accounts of Users who infringe the intellectual property rights of others. If you believe your work has been infringed, please provide a signed notice identifying the copyrighted work and the allegedly infringing material, your contact information, and a good-faith statement, by mail to: IBS RVMarines, 35 Riviera Drive, Unit 9, Markham, Ontario L3R 8N4, Canada.

15. Miscellaneous

These Terms constitute the entire agreement between 1668868 Ontario Inc. and the User regarding the subject matter hereof and supersede any previous agreement. If any portion is found unenforceable, it will be severed and will not affect the remaining terms. Any claim arising out of this Agreement must be filed within one (1) year after the cause of action arose or be forever barred. This Agreement is governed by the laws of the Province of Ontario, Canada, and any action must be filed in a provincial or federal court located in Ottawa, Ontario.

16. Risk of loss

Risk of loss and title for purchased items pass to you upon our delivery to the carrier or, if such items must cross an international border, when they clear customs in Canada/US.

17. Returns, refunds and title

We do not take title to returned items until the item arrives at our fulfillment centre. At our discretion, a refund may be issued without requiring a return, in which case we do not take title to the refunded item. If we receive items that do not meet the requirements of our return policies — including items returned past the eligible window, opened items, or damaged items — we may charge a restocking fee or issue a partial refund.

18. Product descriptions

We attempt to be as accurate as possible, but we do not warrant that product descriptions or other content are accurate, complete, reliable, current, or error-free. If a product offered by us is not as described, your sole remedy is to return it in unused condition.

19. Pricing

"List Price" means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. We cannot confirm the price of an item until you place an order. Despite our best efforts, a small number of items may be mispriced. If the correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel and refund your order and notify you of the cancellation.
